Welcome to www.dementiahub.co.uk (the “Website”), an online community platform operated by Dementia Hub with its registered office at 54 Halton Avenue, Thornton Cleveleys, Lancashire, FY52PR (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Website, including our recurring monthly subscription service (“Subscription Service”). By accessing or using the Website or subscribing to the Subscription Service, you agree to be bound by these Terms. If you do not agree, please do not use the Website or the Subscription Service.

Disclaimer: By using our services, you agree and understand fully that we are not medical professionals and all articles, opinions, statements, and third party links are not endorsed by www.dementiahub with respect to effectiveness or safety.  We recommend that you always consult relevant medical professionals to discuss your individual needs and requirements before undertaking any changes to diets, lifestyles, procedures, or medications.

1. Definitions
User: Any individual or entity accessing or using the Website or Subscription Service.

Subscription Service: The paid, recurring monthly membership providing access to premium features, content, or services on the Website.

Content: Any text, images, videos, or other material available on the Website, whether provided by us or Users.

UK GDPR: The UK General Data Protection Regulation, as retained post-Brexit.

2. Eligibility

2.1 You can be of any age to use our Website and can register as a free member.
2.1.1 You must be at least 18 years old or have the consent of a parent or legal guardian to use the Subscription Service.

2.2 You must provide accurate, complete, and up-to-date information when registering for an account or subscribing.

3. Subscription Service

3.1 Description: The Subscription Service provides access to premium features, such as access to specific pages, exclusive content, forums, events]. Details of the Subscription Service are available on the Website.

3.2 Subscription Fees: The monthly subscription fees are £3.00 if chosen monthly, £30.00 if an annual subscription is chosen, or a one off lifetime membership can be chosen at either £100, £250, or £500. All fees are inclusive of VAT unless stated otherwise. We reserve the right to change fees with [30 days’] notice, communicated via email or the Website.

3.3 Payment: Payments are processed via Stripe. You authorise us to charge your chosen payment method monthly. You must provide valid payment details and ensure sufficient funds are available.

3.4 Automatic Renewal: The Subscription Service renews automatically each month unless cancelled. You may cancel at any time via your account settings or by contacting us at help@dementiahub.co.uk. Cancellation takes effect at the end of the current billing cycle.

3.5 Refunds: No refunds are provided for partial months or unused portions of the Subscription Service, except as required by law (see Section 4).

4. Consumer Rights and Cancellation

4.1 Cooling-Off Period: Under the Consumer Contracts Regulations 2013, if you are a consumer (acting for non-business purposes), you have 14 days from the date of subscribing to cancel the Subscription Service and receive a full refund. To cancel, contact us at help@dementiahub.co.uk or use the cancellation form provided on the Website.

4.2 Service Commencement: By subscribing, you consent to immediate access to the Subscription Service. If you cancel within 14 days, you may be charged for any services used during that period, proportional to the total subscription fee.

4.3 Post-Cooling-Off Cancellation: After the 14-day period, you may cancel at any time, effective at the end of the current billing cycle. No further charges will apply after cancellation.

5. User Accounts

5.1 You must create an account to access certain features or the Subscription Service. You are responsible for maintaining the confidentiality of your login details and for all activities under your account.

5.2 Notify us immediately at help@dementiahub.co.uk if you suspect unauthorised use of your account.

5.3 We reserve the right to suspend or terminate accounts for breaches of these Terms.

6. Acceptable Use

6.1 You agree not to:
Use the Website or Subscription Service for unlawful purposes or in violation of these Terms.
Post or transmit Content that is defamatory, hateful, obscene, discriminatory, or infringes on third-party rights.
Attempt to access, modify, or disrupt the Website’s systems or security.
Share your login details with any other third party

6.2 We may remove Content or suspend/terminate your access for non-compliance with our terms and conditions without notice.

7. Content Ownership and Licensing

7.1 Our Content: All Content provided by us (excluding User Content) is owned by or licensed to us and protected by copyright, trademark, or other intellectual property laws.

7.2 User Content: By posting Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display it on the Website for the purpose of operating the community platform. You retain ownership of your Content but warrant that it does not infringe third-party rights.

7.3 You are responsible for ensuring your Content complies with these Terms and applicable laws.

7.4 You are in agreement that any content you share will be in compliance with all UK Laws and agree to bear full responsibility for any content that is deemed to be in breach of UK Law.

8. Data Protection

8.1 We process personal data in accordance with our Privacy Policy which can be found at www.dementiahub.co.uk/privacy and the Data Protection Act 2018/UK GDPR.

8.2 By using the Website, you consent to the collection, storage, and use of your personal data as described in the Privacy Policy.

8.3 You may request access, correction, or deletion of your personal data by contacting [support email].

8.4 We will process any request for data deletion within 30 days, retaining only data that we are required to hold by Law, data that is a threat to the continuation of our site, or for any Lawful purposes.

9. Intellectual Property

9.1 The Website, including its design, code, and branding, is owned by or licensed to us. You may not copy, modify, or distribute any part of the Website without our written consent.

9.2 You may use the Website and Subscription Service for personal, non-commercial purposes only, unless otherwise agreed in writing.

10. Liability

10.1 Consumer Rights Act 2015: We will provide the Website and Subscription Service with reasonable care and skill. Nothing in these Terms limits your statutory rights as a consumer.

10.2 We are not liable for:
Indirect, consequential, or economic losses (e.g., loss of profits, data, or goodwill).
Issues arising from your failure to comply with these Terms or misuse of the Website.
Interruptions or errors due to factors beyond our control (e.g., internet outages).

10.3 Our total liability for any claim is limited to the amount paid for the Subscription Service in either the preceding 12 months in the case of an annual subscription or the last monthly payment made for ongoing monthly subscriptions.

10.4 Nothing in these Terms excludes your personal liability for death, personal injury, fraud, or fraudulent misrepresentation.

 

11. Termination

11.1 You may terminate your account or Subscription Service at any time via your account settings or by contacting help@dementiahub.co.uk.

11.2 We may terminate or suspend your access if you breach these Terms, with or without notice.  If this happens no refunds will be provided.

11.3 Upon termination for any breach of these Terms, your access to the Subscription Service and any User Content may be removed with immediate effect.

12. Third-Party Links and Services

12.1 The Website may contain links to third-party websites or services. We are not responsible for their content, accuracy, or practices.

12.2 Your use of third-party services is subject to their terms and conditions.

13. Changes to Terms

13.1 We may update these Terms at any time. Changes will be posted on the Website, and for significant changes, we will notify you via email or a Website notice.

13.2 Continued use of the Website or Subscription Service after changes constitutes acceptance of the updated Terms.

14. Force Majeure
We are not liable for delays or failures in providing the Website or Subscription Service due to events beyond our reasonable control (e.g., natural disasters, cyberattacks).

15. Governing Law and Jurisdiction

15.1 These Terms are governed by the laws of England and Wales.

15.2 Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except where EU or other consumer protection laws grant you the right to pursue claims in your local jurisdiction.

17. Complaints and Dispute Resolution

17.2 If unresolved, you may refer the matter to an Alternative Dispute Resolution (ADR) provider, as required under the Alternative Dispute Resolution for Consumer Disputes Regulations 2015.

18. Miscellaneous

18.1 These Terms constitute the entire agreement between you and us regarding the Website and Subscription Service.

18.2 If any provision of these Terms is found invalid under UK Law, the remaining provisions remain enforceable.

18.3 No waiver of any term shall be deemed a further or continuing waiver.
